Sales Conditions and Returns
BINDING AGREEMENT:
SUBJECT TO THE RETURN POLICY BELOW, BUYER HAS THE RIGHT TO RETURN THE GOODS WITHIN 20 DAYS OF THE DATE OF PURCHASE. BUYER FURTHER AGREES THAT RETENTION OF THE PRODUCT BEYOND THIS 20 DAY PERIOD SHALL CONSTITUTE AN IRREVOCABLE ACCEPTANCE OF THE GOOD(S) AND ALL THE TERMS AND CONDITIONS OF THIS SALES AGREEMENT.
GOVERNING LAW AND CHOICE OF FORUM:
This agreement shall be construed and governed in accordance with the laws of the State of New York, regardless of the place or places of its physical execution and performance, and without regard to its conflicts of law rules. The Parties hereto expressly and irrevocably consent that the federal and/or state courts within the state of New York in New York County shall have exclusive jurisdiction and venue to adjudicate any dispute arising out of this Agreement. The Parties expressly consent to personal jurisdiction in the state of New York, which shall be self-operative.
RETURN POLICY:
Under no circumstances will returns be accepted without prior written authorization by TBE.
To be eligible for a return, your item must be unused and in the same condition that you received it.
In order to begin your return, please email fulfillment@drinkbrightfox.com with a copy of your receipt or proof of purchase. You may also forward your initial purchase confirmation email to the email address above in order to begin your return claim.

No return will be accepted without invoice/sales receipt number and date of sale. We will issue you a return authorization number that must be marked on the return package. Returned items will be inspected before a refund is issued. The cost of shipping and insurance shall be the buyer’s responsibility on all returns unless due to our error. You will be responsible for paying the shipping costs (plus insurance) for returning your item. Please retain a copy of your shipping receipt and submit a scan or legible photo in your claim email thread. If you receive a refund, the cost of return shipping will be added to your refund.
When you return your item, we will inspect it and notify you that we have received it. We will immediately notify you on the status of your refund after inspecting the item.
If your return is approved, we will initiate a refund to your original method of payment. You will receive the credit within 3-5 days, or longer depending on your card issuer's policies.
EXCLUSIONS OF IMPLIED WARRANTIES:
This sale is made on the express understanding that there is NO IMPLIED WARRANTY THAT THE GOODS SHALL BE MERCHANTABLE OR AN IMPLIED WARRANTY THAT THE GOODS SHALL BE FIT FOR ANY PARTICULAR PURPOSE. The buyer acknowledges that he is not relying on the seller’s skill or judgment to select or furnish goods suitable for any particular purpose and that there are no warranties which extend beyond the 30-day express limited warranty described below.
THIRTY-DAY EXPRESS LIMITED WARRANTY:
TBE warrants to the original purchaser that the goods are free from defects in material and workmanship for consumption under normal use for a period of 30-days from the date of purchase.
EXCLUSIVE LIMITED REMEDY:
The parties further agree that buyer’s EXCLUSIVE remedy shall be limited to refund or replacement, at the seller’s discretion, and that no other remedy (including, but not limited to , incidental or consequential damages for lost profits, lost sales, injury to property, or any other incidental or consequential loss) shall be available.
How to proceed with a warranty claim:
A proof of purchase receipt showing the date of purchase. When you return your item, we will inspect it and notify you that we have received it. We will immediately notify you on the status of your refund after inspecting the item.
If your warranty claim is approved, we will initiate a refund to your original method of payment. You will receive the credit within 3-5 days, or longer depending on your card issuer's policies.

SEVERABILITY:
If any provision of this Conditions of Sale Agreement is prohibited by law or held to be invalid, illegal or unenforceable, the parties hereto agree to the fullest extent permitted by law that the validity, legality and enforceability of the other provisions shall not be affected or impaired thereby.
